Mr. Mehta, the Founder and Managing Partner of our firm, brings with him over 20 years of experience in law practice, where he has successfully handled a diverse range of clients and practice areas. With a specialization in Intellectual Property Law, including trademarks, patents, copyright, and industrial design, Mr. Mehta has established himself as a trusted advisor in the field.

His extensive experience has allowed him to effectively represent and cater to the intellectual property needs of multinational corporations, Fortune 500 companies, as well as small businesses and individuals. Mr. Mehta's clientele spans various industries across the globe, highlighting his ability to navigate and address the unique challenges presented by different sectors.

Mr. Mehta's notable achievements also include his appointment as a "Facilitator" under the "Scheme for Facilitating Start-Ups Intellectual Property Protection" by the Department of Industrial Policy and Promotion (DIPP). This prestigious role demonstrates his expertise and recognition in supporting and guiding startups in protecting their intellectual property. Through his facilitation and mentoring roles, Mr. Mehta actively contributes to the growth and success of startups and established businesses by enabling them to navigate the complex landscape of intellectual property protection and strategy development.

Mr. Mehta handles both contentious and non-contentious IP issues for a number of companies and other entities in India and abroad. He conducts availability searches and provides clearance opinions for the availability of trademarks, service marks, geographical indications, trade dress, trade names, domain names and industrial designs, based on searches at the databases of IP Office & MCA, WhoIs searches, online investigations, market enquiries and surveys, common law sources, etc. He advises clients on the availability of trademarks for exclusive use; likelihood of registration; likelihood of successfully overcoming an objection/challenge by an examiner or third party based on existing marks and the likelihood of successfully challenging any third party against infringing use. He also organizes searches at the Copyright Office and Designs Office and prepares availability and clearance opinions based thereupon.

Mr. Mehta assists clients in obtaining and protecting their trademarks, copyrights and designs in India as well as in South Asian jurisdictions, through a network of preferred agents. His practice primarily includes preparing and filing applications for registration of trademarks, patents, copyrights & designs, drafting and filing responses to office actions, obtaining registration of trademarks, trade-dress and service marks at the TM Office, trade-name registrations, Patents, GI Registrations. He has successfully prosecuted a range of regular and specialized types of trademark applications, including collective marks, certification marks, priority marks and textile marks. He also assists in filing for and obtaining registration of copyrights and industrial designs and also attend hearings at the Trademark Office, Copyright Office, Designs Office and the IPAB.

In addition, contentious administrative proceedings at the Trademarks Office, Copyright Office, Designs Office, NIXI (National Internet Exchange of India), and the IPAB (Intellectual Property Appellate Board) are handled by Mr. Mehta. This includes drafting and reviewing notices of opposition and cancellations, counter statements to notices of opposition, affidavits by way of evidence. He advises clients in strategizing negotiations carried out with adversaries and on structuring successful and profitable settlement, and drafts undertakings and settlement agreements. He attends hearings at the Trademarks Office, Copyright Office, NIXI, Designs Office and IPAB in relations to contentious matter proceedings.

Mr. Mehta works closely with the clients in devising effective and aggressive enforcement strategies, which include conducting use and entity investigations, drafting and issuing Legal Notices, conducting raids with local officials, registering IP rights with custom authorities, sending notices to ISPs (Internet Service Providers) and taking appropriate action before the Trademark Office, Copyrights Office, Copyright Board, Copyright Societies, GI Registry, IPAB, Controller of Certifying Authorities, etc. He is involved in enforcement actions involving trademarks, copyright and related rights, piracy, cyber-squatting, unauthorized access, misappropriation of confidential information, breach of confidentiality, misrepresentation, unfair trade and anti-competitive practices, etc. He is also involved in enforcement action involving protection against infringement of trademarks & copyrights. He has also successfully represented several domestic and international clients in domain name administrative proceedings under the INDRP and UDRP.

Mr. Mehta has hands-on experience in litigation pertaining to trademark infringement and passing off, trade name disputes, false advertising, trademark dilution, trademark debasement, domain name disputes and piracy of GIs, designs and copyrights. He assists and advises clients in lawsuit strategy and preparing for various activities at different stages of litigation. His practice involves filing lawsuits, complaints and petitions before High Courts, the Supreme Court of India, relevant district courts as well as statutory quasi-judicial tribunals including boards, regulatory authorities and commissions.
